Wine-Specific Conditions

Legal Requirements

You must be 21 years of age or older, to order or receive alcoholic beverages from Barrel Oak Winery LLC. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from Barrel Oak Winery LLC are not for resale, and are for personal consumption only.

Barrel Oak Winery LLC Shipping Policies

  1. UPS cannot deliver wine to P.O. boxes, so please provide a physical address where someone 21 or older can sign for the wine.
  2. All packages containing alcohol must be signed for upon delivery by an adult (21 years of age or older). UPS will not leave such packages on the door step, even if the recipient has requested this.
  3. All orders are shipped and delivered Monday through Friday.
  4. Orders are shipped via UPS Ground, unless expedited shipping is specified.
  5. All orders will be processed as quickly as possible. Please allow 24-48 hours to process your order before shipping.
  6. Orders placed after 12:00pm EST are processed the following business day.
  7. Delivery of the package depends on the distance from our winery and the day the order was received.
  8. We do not offer International sales or shipping.
  9. UPS will attempt to deliver packages containing alcohol 3 times before sending it back. Barrel Oak Winery LLC is not responsible for additional shipping charges.
  10. If a package returns, please contact the Barrel Oak Winery LLC at (540) 364-6402 x1. A re-shipping fee will be applied to all orders that are reshipped.

Purchasing

  1. A $20 Minimum Credit Card Charge Is Required.
  2. Forms of Payment. When ordering products on the Website, Buyer may use Visa, Mastercard, Discover or American Express. Barrel Oak Winery LLC will not accept checks, wire transfers or COD payments. If Buyer fails to pay for any products received, Barrel Oak Winery LLC shall have the right, in addition to other remedies, to suspend or cancel further deliveries, and to proceed in any court of proper jurisdiction against Buyer for all amounts due to Barrel Oak Winery LLC, including, but not limited to, attorney fees, costs and interest.

States Authorized for Direct Shipment

Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to all states except AL, AR, HI, IL, KY, MA, MS, MT, NJ, NY, OK, PA, SD, TN, TX, and VT. If Barrel Oak Winery LLC is unable to ship directly to your state, we can arrange for the sale and shipment of our products through a third party. Please note, when dealing through a third party, wine prices, discounts, and shipping costs may differ from those quoted by Barrel Oak Winery LLC.

Shipping Costs

UPS Ground is Barrel Oak Winery LLC carrier of choice. Ground shipping is provided by UPS at rates that will be set and stated prior to product purchase by Barrel Oak Winery, LLC.

Wine is a Delicate & Perishable Commodity

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. Barrel Oak Winery LLC is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.

Returns, Cancellations, & Limitations

Replacements and Refunds

Barrel Oak Winery, LLC will replace or refund you for any bottle of wine that is damaged, flawed or that the customer finds unsatisfactory. We ask the customer return the unfinished portion of the original bottle for replacement. By law, we cannot accept returns of alcoholic beverages unless the product is corked or flawed. We are also unable to accept return of wine that was damaged due to adverse weather conditions during shipment or storage at your premises, or wine that is ordered in error. Please send an email to info@barreloak.com to arrange for the return of corked or flawed product.
Once the wine is received, we will refund your credit card account for the cost of the wine less shipping and handling. If the original shipment was damaged or flawed you will receive a full refund, including shipping and handling charges. Please contact the tasting room at 540-364-6402 x1 or x4 for return instructions.

Indemnification

Buyer shall defend, indemnify and hold Barrel Oak Winery LLC and its suppliers, including, but not limited to, their affiliates, agents, assigns, attorneys, employees, insurers, officers, predecessors, representatives, and successors, harmless from and against all claims, liabilities, costs and expenses (including, but not limited to, those related to injury or to death of Buyer or other persons) arising from or connected with (a) a breach by Buyer of this Agreement or (b) the possession, handling, use, or resale of the products by Buyer or others, including, but not limited to, any claims alleging negligence on the part of Barrel Oak Winery LLC. Barrel Oak Winery LLC may participate in the defense of any such claim for the further protection of its own interests.

Limitation of Claims

Without limiting the scope of any other terms and conditions herein, any and all claims related to products sold to Buyer through the Website shall be made within fourteen (14) days after receipt of the product to which the claim relates, or if for non-delivery, after the scheduled delivery date thereof. Buyer’s failure to give Barrel Oak Winery LLC written notice of any claim within the applicable time period shall constitute an absolute and unconditional waiver of such claim. In no event shall Buyer commence any action against Barrel Oak Winery LLC related to products sold to Buyer through the Website later than one year after receipt of the product giving rise to such action.

Limitation of Liability

Without limiting the scope of any other terms and conditions herein, including Barrel Oak Winery LLC, disclaimer of warranties, no claim of any kind, whether as to products delivered or for non-delivery of products, or otherwise, and whether based on contract, breach of warranty, negligence, strict liability, indemnity, contribution, or otherwise, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. IN NO EVENT SHALL Barrel Oak Winery LLC BE LIABLE FOR LOSS OF BUSINESS, LOSS OF PROFITS OR GOOD WILL, OR ANY OTHER INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER BUYER’S CLAIM IS BASED ON CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, INDEMNITY, CONTRIBUTION, OR OTHERWISE, AND NOTWITHSTANDING ANY CLAIM THAT SUCH LOSSES WERE REASONABLY FORESEEABLE TO Barrel Oak Winery LLC OR ANY FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY.

Force Majeure

Without limiting the scope of any other terms and conditions herein, Barrel Oak Winery LLC shall not be responsible or liable for any delay or failure to deliver any or all of the products for causes beyond its reasonable control, including, but not limited to, any cause or circumstance which makes impracticable the production, transportation or delivery of the products. Barrel Oak Winery LLC may cancel an order to the extent the quantity not delivered is due to any such cause or circumstance. In no event shall Barrel Oak Winery LLC be obligated to purchase products to replace any quantity not delivered due to any such cause or circumstance. In the event of any cause or circumstance excusing Barrel Oak Winery LLC, Barrel Oak Winery LLC shall have the right to allocate any remaining product supply among its customers, including those not under contract, in a fair and reasonable manner, and Buyer hereby releases Barrel Oak Winery LLC from responsibility or liability for any resulting incomplete fulfillment of Buyer’s order.
